We are Herts Ability.  Our registered address is The Weltech Centre, Ridgeway, Welwyn Garden City, Hertfordshire, AL7 2AA, our Company Number is 03249335 and our Charity Number is 1059015.  

We have created this Privacy Notice to help you understand what personal data we process and how we use it in our business dealings with you.  We are registered with the ICO ZA777047 and our accreditation body is Driving Mobility.

We are a Data Controller when we deal with our own clients, potential clients or website users data. Our website is not intended, and we do not knowingly collect data relating to children


How do we process your personal data?

So that we can provide a service to you need to process some of your personal data.  We make sure that we only collect what we need and have outlined below the various ways in which we process your personal data:

When you visit our website

We use cookies on our website which collect various types of personal data. This will include details about your visits to our website; page views, downloads, navigation and exit; IP address; geographical location; browser type and version; operating system; referral source; length of your visit.

Our website may contain links to other external websites.  We aren’t responsible for the practices, policies or content of such websites and suggest that you check their privacy policies to ensure that you are happy to continue browsing.

When you become one of our clients

We will process your name, contact details, date of birth, driving licence information and National Insurance number so that we can fulfil our contract to you and answer any enquires you may have.  

Sento enable payment for our services, unless you have been referred to us by another party.

In order for us to assist you we need details about your health and ethnicity and will ask for your explicit consent as part of our application process.  You do not have to answer questions relating to your ethnicity if you choose not to.

We have a legitimate interest in storing personal data regarding your assessment.

We have either received your details from yourself or someone else such as the DVLA or other partners we work with.

When you join our marketing list

We will collect your name and contact details so that we can send you appropriate marketing communications.  We need your consent to send you marketing messages however, you are welcome to unsubscribe at any time.

When you send us an enquiry

You may have sent us an enquiry via the contact page on our website.  We will collect your name and contact details as it’s in our legitimate interest to do so that we can enter into correspondence with you and answer your enquiry.


How long do we keep your personal data?

If you are on our marketing list

If you remain part of our active marketing list, we will keep your personal data until you opt out.  At that point we will use a suppression list to ensure that we don’t contact you in error.

If you have consented to non-essential cookies

You can find out more and update your preference on our Cookies Consent Management Platform.

If you are a client of ours

We will keep your personal data for as long as we have a contract with you and then for a further 7 years in accordance with HMRC guidelines and fulfil our legal obligations.  However, we securely destroy personal data we no longer need, such as your National Insurance number once your assessment has been completed.


How do we use your personal data to communicate with you?

Non-Marketing Communications include:

Service messages, invoices, answers to enquiries and other communications to ensure that we deliver the services you have engaged us for.

Marketing Communications include:

Emails regarding other services we offer as well as content marketing we hope you will find useful.  You are welcome to unsubscribe from marketing messages at any time.

If you have consented to marketing cookies such as Facebook Pixels you may be served Facebook Ads regarding our services.  You can change your cookies consent at any time by visiting our Cookie Consent Management Platform.  You may also wish to change your Facebook settings if you don’t want to see targeted advertising.

Social Media

We use Facebook, Twitter, Instagram and Linkedin. We sometimes use paid advertising on these platforms, but we will only use custom audiences with your consent.  You can find a copy of this Privacy Notice on our Facebook page in the ‘About’ section.

Social Plugins

We use social plugins on some of our website pages which allow you to share these pages with your friends and families.  These buttons are deactivated by default and only activated once you click on them.  When you click on these buttons your personal data will be transferred to the plugin provider.  This will include IP addresses which are then used to serve you relevant ads.


Who has access to your personal data?

We share your personal data with various organisations so we can:

  • Fulfil our contract with you to help us run our business, to 
  • Fulfil our legal obligations*,
  • Inform your Next of Kin with your prior consent.

*We may share your details to organisations without your consent where we are required to do so by the law, such as the DVLA and the Police Service. We share aggregated, non-personal details about ethnicity to the Department of Transport.

These include:

  • DVLA
  • Medical Professionals
  • the Police Service
  • Accountants
  • Webhosts.

We also use Microsoft, Mailchimp and Survey Monkey to ensure that we run our business efficiently.

We ensure that our systems are robust and we will only share your data with organisations who have appropriate safeguarding mechanisms in place such as Standard Contractual Clauses.  We have Data Processing Agreements with our Data Processors and never sell personal data to third parties.

In the event that Herts Ability is sold or transfers its assets to another party, your personal data could be one of the transferred assets. If your personal data is transferred it will remain subject to this Privacy Notice. Your personal data will be passed onto a successor in the event of a liquidation or administration.


What are your rights?

You have several rights which you can access free of charge.  In certain circumstances we reserve the right to charge a reasonable fee if your requests are unfounded or excessive.

You have the right:

  • To be informed about the collection and use of your personal data.
  • To access your personal data via a Data Subject Access Request (DSAR)
  • To have inaccurate personal data corrected or completed
  • To have your personal data erased
  • To restrict our processing of your personal data
  • To request the transfer of any personal data you have provided to us 
  • To object at any time to direct marketing
  • To object to automated decision making and profiling

We do not use automated decision making or profiling.

If you wish to exercise any of these rights, please contact us via driving@hertsability.org.uk We will respond to you within one month.  If your request is complex and we require more time, we will contact you and let you know within the first month.


How can you submit a query or a complaint?

If you have a complaint, please get in touch with us so that we can resolve any concerns.  You also have a right to lodge a complaint with the Information Commissioners Office if you believe your personal data has been processed in a way which does not comply with Data Protection Legislation.  You can call the ICO helpline on 0303 123 1113 or visit their website here.
